Section 1 - Notices to Homeowners Association :

1.1 - Traffic

The purpose of this display is to bring joy to the people of Middletown, most of which are from Wesleyan Hills; there's already people parking on the street every day, so if someone comes to see the display and stops for 2 minutes it would have absolutely no effect since you would have to go around anyway. there will not be crazy traffic, even at the biggest display in Connecticut there is no more than 5 cars there at a time and that display and home is at least 5x bigger, there is no possible way it can reach that level on Blue Orchard.

1.2 - Noise

Speakers will only be used on Halloween, when I am testing, and if there is someone outside that I see that is not in a car I would turn up the music just so they can hear, other than that, there is no noise due to the audio being over FM radio and not playing outside. fog machines and other props do make noise but these are only used on select days.

1.3 - Light pollution

I am now trying to use darker colors so that the lights do not illuminate adjacent properties, as per the ARLC guidelines; in the event a light fixture is obtrusive, please email me immediately using the contact info at the bottom of this page.

1.4 - Ariel effects

Fog is used only on select days, there is the possibility of the street having fog linger around for a few minutes but I use quick dissipating fog fluid so this should not be a major problem. Fog is safe to breathe and does NOT trigger Asthma. We only use Chauvet, Froggy's Fog, or Code 6 fog fluid.

1.5 - Operating hours

The display only runs until 10 PM at the latest. There will be no late-night disturbances. This is NOT a business, the hours are simply there as a reference to when the show computer runs the show.

1.6 - Website and social media

This website and all social media were created for the purpose of informing people on how things work and also giving updates, such as "Do not come out and look tonight because inclement weather will cause the display to be closed." The website is advertised via signage (see 1.7) but this is just for updates and to learn more as mentioned and not to gain any monetary benefit, I make no money off of this whatsoever (see 1.9).

1.7 - Use of signs

Although signs aren't allowed under the ARLC rules, the "TUNE TO" sign is only illuminated every few minutes for 2-3min, this encourages people to leave after the song is over and also keeps the sign out of sight when it's not on since it uses lights, it's just a black rectangle when its not on, and the signs telling people to go to this very website are only visible if you're standing in our driveway.

1.8 - Disapproval

I've always received such wonderful feedback, and I Appreciate it greatly; But in the event you do not like something about the display, we ask that you contact us before reporting to the Wesleyan Hills, 1) because I would rather have someone give me a heads up & 2) because it would be totally ineffective... by the time it is processed, the display would have already been taken down for the season, and therefore would make no difference, especially not an immediate one.

1.9 - Use of the "Blue Orchard" name and Monetization

We are NOT a company, I just used the name of the street because it's easy for people to remember. there is absolutely NO money made from this, Period.

1.10 - Unsightly cables

All cables are temporary and will be taken down at the end of the season, some are ran underground or in a line pattern.

Section 2 - Security

2.1 - Cameras

There are always cameras monitoring all angles of our property 24/7/365, but during Halloween and Christmas, extra cameras are added to ensure all equipment, props, etc. stay safe and that nobody is in any restricted areas. Cameras are not to be destroyed, dismounted, disconnected, etc. Footage of person(s) committing any crimes on the property will be immediately sent to the Middletown Police Department.

2.2 - Destruction, Tampering, and Stealing

Things like vandalism, tampering with equipment, and theft are NOT tolerated.

Even if it is accidental damage - such as your child running in when you look away - you will be responsible to pay for what you / your children have broke.

2.3 - Disconnecting / cutting / dismantling wires

Do not touch any 120VAC lines or communication cables to the display, this is considered tampering (see 2.2), this is also a safety hazard since you may get shocked or electrocuted when touching wires within restricted areas.

2.4 - Locks

Locks are used on the equipment shack and also speakers/lights, If you try to remove or cut the locks / the cables going to them the police will be notified and footage will be sent - they're there for a reason....

2.5 - Restricted Areas

All person(s) are to remain outside of restricted areas at ALL TIMES (see 3.1), anyone seen entering a restricted area purposefully will be required to leave the premises immediately.

Section 3 - Safety

3.1 - Fencing

DO NOT cross the fence lines on the display, there are low hanging branches, trussing, and other things to hit your head on and if not that you'll get steamed up your leg from a milion degree fog machine - so please stay on the outside - the fence is there for a reason

3.2 - Cables on the ground

Please watch where you are going! there is warning tape lining where cables are placed on the ground.

3.3 - Lights in eyes

Lasers and other lights are very low wattage, they will not damage the cornea by any means. Our lasers do not require a variance (see 4.2). Always try and avoid direct eye contact with the lights.

3.4 - Mounted items

Things mounted on trussing are securely fastened with lag bolts or U-brackets, both of which are able to handle the load that is on them just fine, but please do not walk under these as they are already in places that would be off-limits.

3.5 - Restricted areas

DO NOT enter any area that has warning tape, signage, or other warning/barrier in order to stay safe and not damage equipment.

3.6 - Strobes and epilepsy

There are illuminated signs both in the front and back of the front lawn disclaiming that there are strobe lights being used, do not stare at strobe lights if you have photosensitive epilepsy.

Section 4 - Legal requirements

4.1 - FM radio transmissions

Our radio transmitter complies with the FCC part 15 rules for unlicensed low-power radios, therefore our use of FM transmissions is completely legal

4.2 - Laser Variance

A Variance, or laser license, is not required for the lasers we use since they are so low power, we make sure that the laser beams do not point up in the sky, which would be illegal.

4.3 - FAA

We only use low-power lasers, which are not shone in the sky; the 5R beam and 10W/75W LED fixtures we use have significant light-divergence at a certain distance that prevents the beams from reaching the height of any flying aircraft, which therefore does not require any FAA clearance.
